Terms of Service

1. Parties and Scope

These Terms of Service (“Terms”) govern your access to and use of the website scrayos.net and its content (the “Website”), operated by Scrayos UG (haftungsbeschränkt). The company address and registration details are published in our Legal Notice. By accessing or using the Website you accept these Terms.

Separate terms may apply to individual products and services we operate — in particular the Minecraft network JustChunks. Where such separate terms exist, they take precedence over these Terms for the respective service.

2. Overview of the Website

The Website is an informational offering. It presents our company, publishes editorial and technical articles about our development work, and provides legally required information such as the legal notice and the privacy policy. It does not require registration, and no user accounts are offered.

3. Permitted Use

When using the Website you must comply with applicable law. In particular, you must not:

  • interfere with the availability, integrity or security of the Website or the servers delivering it;
  • use automated means to access the Website in a way that places an unreasonable load on our infrastructure;
  • circumvent technical protection measures, or attempt to gain unauthorized access to systems or data;
  • use the Website to distribute malware or to carry out unlawful activities of any kind.

Access to the Website is provided free of charge. No claim to availability arises from these Terms.

4. Content and Intellectual Property

All content published on the Website — in particular texts, images, graphics, source code excerpts, layout and design — is protected by German copyright law. Reproduction, editing, distribution and any kind of exploitation beyond the limits of copyright law require our prior written consent or the consent of the respective rights holder. Downloads and copies of this Website are permitted for private, non-commercial use only.

Quoting short excerpts with a clear attribution and a link to the original article is permitted. Where content on the Website was not created by us, the rights of third parties have been respected and such content is marked accordingly. If you nevertheless become aware of an infringement, please notify us and we will remove the content in question without delay.

Third-party trademarks and product names mentioned on the Website are the property of their respective owners. Minecraft is a trademark of Mojang AB; we are not affiliated with, endorsed by or associated with Mojang AB or Microsoft.

5. Submissions and Correspondence

If you send us feedback, suggestions or other materials — for example by e-mail or through the channels listed on our Contact page — you grant us a non-exclusive, worldwide, royalty-free right to use them for the purpose of operating and improving our services. You remain responsible for ensuring that you are entitled to share such material. We are under no obligation to treat unsolicited submissions as confidential.

6. Third-Party Links and Embedded Content

The Website contains links to external websites over whose content we have no influence. The respective provider or operator is always responsible for the content of linked pages. Those pages were checked for possible legal violations at the time of linking; no unlawful content was apparent at that time. A permanent monitoring of linked pages is not reasonable without concrete indications of an infringement. We will remove such links immediately once we become aware of a legal violation.

Some articles embed videos hosted by YouTube. These embeds are only loaded after you actively click the preview, so no connection to YouTube is established beforehand. Once loaded, the terms and privacy policy of the respective provider apply in addition to these Terms.

7. Availability and Changes to the Website

We strive to keep the Website available without interruption, but we do not warrant uninterrupted or error-free operation. Maintenance, technical faults or circumstances beyond our control may lead to temporary restrictions. We may change, restrict or discontinue the Website or individual parts of it at any time.

8. Warranty Disclaimer

The Website and its content are provided “as is” and “as available”. The articles published here describe our own technical experience and do not constitute professional, legal or business advice. We do not warrant that the information provided is complete, current or suitable for any particular purpose. To the extent permitted by applicable law, all implied warranties are disclaimed.

9. Limitation of Liability

We are liable without limitation for intent and gross negligence. Liability for slight negligence is limited to the breach of material contractual obligations (obligations whose fulfilment makes the proper execution of the agreement possible in the first place and on whose observance you may regularly rely), and in that case limited to the foreseeable damage typical for this type of agreement.

Liability for injury to life, body or health, and mandatory statutory liability — in particular under the German Product Liability Act (Produkthaftungsgesetz) — remain unaffected. Our responsibility as a service provider under §§ 7 to 10 of the German Telemedia Act (TMG) is set out in our Legal Notice.

10. Data Protection

Information on which personal data we process, for what purposes and on which legal basis, as well as on your rights as a data subject, can be found in our Privacy Policy.

11. Changes to These Terms

We may amend these Terms in order to reflect changes to the Website, to our services or to the legal framework. The version published on this page at the time of your access applies. Continued use of the Website after a change constitutes acceptance of the amended Terms.

12. Governing Law and Jurisdiction

These Terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer with habitual residence in another country, mandatory consumer protection provisions of that country remain unaffected.

To the extent legally permissible, the exclusive place of jurisdiction for all disputes arising out of or in connection with these Terms is Bonn, Germany.

13. Severability

Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions remains unaffected.
